At Klimek Jewellers, we offer a reliable and transparent service for buying scrap gold from customers. By selling your gold to us, you agree to the following terms and conditions, which comply with UK trading standards and relevant laws, including those under the Consumer Contracts Regulations and the Money Laundering, Terrorist Financing and Transfer of Funds Regulations.
1. Definitions
- "We", "Us", "Our" refer to Klimek Jewellers.
- "You", "Your" refers to the individual selling scrap gold to Klimek Jewellers.
2. Identification Requirements
- In compliance with the UK Money Laundering Regulations, all customers selling scrap gold must provide valid identification, including:
- A government-issued photo ID (e.g., passport, driving licence).
- A recent utility bill or bank statement (dated within the last three months) showing your current address.
- We reserve the right to refuse to purchase gold if sufficient ID is not provided or if there are any concerns regarding the origin of the items.
3. Testing and Valuation of Gold
- We will assess the gold brought in for sale using industry-standard methods to determine the gold's purity and weight.
- Gold items will be weighed on a certified trade scale, which is regularly calibrated to ensure accuracy.
- The value of your scrap gold will be based on the current gold market price at the time of testing and offer. Prices are calculated according to the weight and purity of the gold and may fluctuate due to market conditions.
4. Payment for Scrap Gold
- Once we have tested and valued your gold, we will make an offer based on the current gold market rate. This offer is final, and there is no obligation to accept it.
- If you accept the offer, payment will be made by:
- Cheque
- Bank transfer to your account, usually processed on the same day.
5. Customer Agreement
- By selling your scrap gold to Klimek Jewellers, you confirm that:
- You are the legal owner of the gold items and have the right to sell them.
- The gold has been obtained legally and is not associated with any criminal activity.
- You are over the age of 18 years, as required by UK law for selling scrap gold.
6. No Obligation to Sell
- You are under no obligation to accept the offer we provide for your scrap gold.
- If you choose not to accept the offer, the gold will be immediately returned to you, with no charges incurred for the valuation process.
7. Types of Gold We Accept
- We accept all types of scrap gold, including but not limited to:
- Broken or damaged jewellery
- Gold coins (Sovereigns and Krugerrands)
- Unwanted gold items
- We purchase gold in varying purities, including 9ct (375), 14ct (585), 18ct (750), 22ct (916), and 24ct (999).
- Please note that we do not purchase gold-plated or vermeil items, only solid gold.
8. Right to Refuse
- Klimek Jewellers reserves the right to refuse to buy any scrap gold if:
- The items do not meet our quality or testing standards.
- The customer fails to provide sufficient identification.
- There are concerns about the legal ownership of the gold.
9. Transaction Limits
- For high-value transactions exceeding £10,000, additional anti-money laundering checks may be required in compliance with UK law. This may include asking for additional documentation or verification of the origin of the gold.
10. Refunds
- Once the transaction is completed and payment has been made, the sale is final, and no refunds will be issued for scrap gold sold to us.
11. Consumer Rights
- In compliance with the Consumer Contracts Regulations, when you sell gold to Klimek Jewellers in person, you are entering into a business-to-consumer contract. However, please note that cooling-off periods do not apply to in-person sales of scrap gold.
12. Data Protection
- Klimek Jewellers is committed to protecting your personal data and will only collect the necessary information to comply with UK Money Laundering Regulations and to complete the transaction.
- Your data will be handled in accordance with the UK General Data Protection Regulation (GDPR) and will not be shared with third parties without your consent unless required by law.
13. Governing Law
- These terms and conditions are governed by and interpreted in accordance with the laws of England and Wales. Any disputes arising from this agreement will be subject to the exclusive jurisdiction of the courts of England and Wales.
14. Changes to Terms and Conditions
- Klimek Jewellers reserves the right to update or amend these Terms and Conditions at any time to ensure compliance with changes in UK law or our business practices. Any updates will be published on our website, and it is your responsibility to review them before selling scrap gold to us.
